Crafting an Agreement to Match Your Goals

A prenuptial or postnuptial agreement can be used to modify many of the terms of the marriage relationship. That includes removing community property rights, protecting separate property from becoming community property, and setting the terms for any alimony.

Prenuptial agreements are most common among people who have substantial assets prior to marriage. Postnuptial agreements are most frequently adopted as part of the reconciliation process after a separation or when couples want to modify their prenuptial agreements.

It is more likely that your prenuptial agreement will be enforced if each party has an attorney, and the agreement must be completed well before the wedding.

The requirement that each party must have a lawyer also applies to postnuptial agreements. The family court may also reject a prenuptial or postnuptial agreement if the judge has any other reason to believe that one party signed it under duress or undue influence.
