Understanding the Contested Divorce Process

Nevada is a no-fault divorce state, which means that you do not need to have grounds, such as adultery or cruelty, to get a divorce. A divorce is considered contested if there are any issues that need to be resolved that the parties cannot agree on ahead of time.

The main issues that get resolved through contested divorce are the following:

  • Division of assets and debts: Under Nevada community property law, most types of assets and debts acquired during the marriage must be divided in a divorce.
  • Alimony: Judges in Nevada have a great deal of discretion to award alimony, which makes it a hotly contested issue in many divorce cases.
  • Child custody: The trend in child custody is toward giving both parents as much time with their children as possible. However, this is not appropriate in every case.
  • Child support: Nevada has a fairly straightforward set of guidelines for calculating child support. However, there can be complications in how it is determined.

Divorce is typically a two-track process. While helping my clients pursue long-term resolutions to contested issues, I also obtain temporary orders to ensure that their financial rights and relationships with their children are protected while their divorce cases are pending.
